THE LEGAL FRAMEWORK OF THE EXPORT OF HIGHER EDUCATION SERVICES: MODES OF SUPPLY, REGULATORY MODELS AND THE EXPERIENCE OF UZBEKISTAN

Abstract
The article examines the export of higher education services as a legal and economic category. The author classifies education export through the four modes of supply established by the General Agreement on Trade in Services (GATS) and analyses the legal forms in which transnational education is delivered: international branch campuses, franchising, validation, joint and double degree programmes and cross-border online provision. Particular attention is paid to the regulatory problems that accompany these forms — licensing, quality assurance, the recognition of qualifications, the protection of students as consumers and the taxation of cross-border educational services. The Australian, British, Malaysian and Emirati regulatory models are compared. On the basis of the analysis the author formulates proposals for the development of the legal framework of education export in the Republic of Uzbekistan.
